Terms of Service

1. About AccreditAZ

AccreditAZ is operated by SecureAZ Limited, a company registered in New Zealand. AccreditAZ provides a cloud-based certification, accreditation, and compliance management platform ("the Platform") designed to help organisations manage their cybersecurity compliance obligations including NZISM certification and accreditation, risk management programmes, incident reporting, and related services.

2. Acceptance of Terms

By accessing or using the AccreditAZ Platform, you confirm that you are at least 18 years of age and that you have the authority to bind the organisation you represent to these Terms of Service. If you do not agree with these terms, you must not use the Platform.

3. Platform License

AccreditAZ grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your organisation's internal compliance management purposes, subject to these terms. You agree not to:

  • Reproduce, duplicate, copy, sell, or exploit any portion of the Platform without express written permission
  • Attempt to gain unauthorised access to any part of the Platform, its servers, or connected systems
  • Introduce malware, viruses, or any harmful code to the Platform
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Scrape, harvest, or collect data from the Platform by automated means
  • Share your login credentials with unauthorised parties
  • Impersonate another person or entity when using the Platform

4. Account Registration and Security

You must provide accurate and complete information when registering an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify AccreditAZ immediately of any suspected unauthorised access.

AccreditAZ is not liable for any loss or damage arising from your failure to maintain the security of your credentials.

5. Compliance Data and Responsibilities

The Platform is a tool to assist with compliance management. AccreditAZ does not guarantee that use of the Platform will result in certification, accreditation, or regulatory compliance. You remain solely responsible for:

  • The accuracy and completeness of all data, evidence, and documentation entered into the Platform
  • Ensuring your organisation meets all applicable legal and regulatory obligations
  • Obtaining any necessary approvals, certifications, or accreditations from the relevant authorities
  • Making independent assessments of your compliance posture

6. Data Processing

AccreditAZ acts as a data processor for compliance data entered into the Platform. Your organisation remains the data controller under the New Zealand Privacy Act 2020 and any other applicable data protection legislation. Our processing of personal data is governed by our Privacy Policy.

7. Payment Terms

Subscription fees are as set out in your service agreement or as displayed on the Platform at the time of purchase. All invoices are due within 14 days of issue. Fees are non-refundable except where required by New Zealand consumer protection law.

Subscriptions renew automatically at the end of each billing period unless you provide at least 30 days' written notice of cancellation prior to the renewal date.

8. Service Availability

AccreditAZ aims to maintain Platform availability but does not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. We are not liable for any downtime, data loss, or service interruption caused by factors beyond our reasonable control.

9. Limitation of Liability

The Platform and all related services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, AccreditAZ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities arising from your use of the Platform.

AccreditAZ's total aggregate liability to you for any claims arising from or relating to these terms or the Platform shall not exceed the total fees paid by you in the 12 months preceding the claim.

10. Intellectual Property

All content, features, functionality, trademarks, and intellectual property on the Platform are owned by SecureAZ Limited or its licensors. You retain ownership of data you upload to the Platform, but grant AccreditAZ a licence to process that data as necessary to provide the services.

11. Termination

AccreditAZ may suspend or terminate your access to the Platform at any time for breach of these terms, with or without notice. Upon termination, you may request an export of your data within 30 days, after which AccreditAZ may delete your data.

12. Governing Law

These terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.

13. Changes to Terms

AccreditAZ reserves the right to update these terms at any time. We will notify you of material changes via email or a prominent notice on the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the revised terms.
